Powers of Attorney - Turkey

Description

Power of Attorney for Property Purchase in Turkey (Vekâletname)

power of attorney in Turkey is a legal document by which one person (the buyer) authorises another person (often a lawyer or trusted representative) to act on their behalf when purchasing a property.

It is commonly used when the buyer cannot be present in Turkey to:

  • Sign the purchase documents
  • Complete the transfer of title at the Land Registry Office (Tapu Müdürlüğü)
  • Represent the buyer before notaries, tax offices, and public authorities
  • Pay purchase taxes, fees, and registration costs
  • Handle related administrative matters (utilities, municipality)

Key features

  • It is usually a special (limited) power of attorney, restricted to a specific property purchase
  • The document must clearly state:
    • The buyer and authorised representative
    • The property details (address, parcel / title details)
    • The exact powers granted, including authority to complete the title deed transfer
  • It must be issued before a Turkish notary or a Turkish consulate
  • If signed outside Turkey (not at a consulate), it must generally be:
    • Apostilled, and
    • Officially translated into Turkish

Duration & control

  • It applies only to the purchase described
  • It can be revoked at any time before completion
  • It automatically ends once the purchase is completed or if the buyer dies
